The Guardianship Hearing

Chapter 12 - The Guardianship Hearing

Vivian continued pursuing emergency guardianship, arguing Elena lacked stable housing and had concealed her identity while employed as staff.

The court reviewed the clinic audio, forged birth record, employment history, and independent medical evaluations.

Elena had no psychiatric incapacity.

She had been frightened, exhausted after childbirth, and separated from her baby.

Those were circumstances, not diagnoses.

Vivian’s attorney emphasized that Elena lived in a servant’s room.

Elena answered:

“I lived where your client placed me while I searched for documents she hid.”

The judge denied the petition.

Elena retained full parental rights.

The court barred Vivian and Dr. Mercer from contacting her or Noah.

The Vance trust funded independent housing because it owed Elena resources—not because assistance purchased authority over her choices.
