The Guardianship Hearing

Chapter 12 - The Guardianship Hearing

The guardianship petition reached court before criminal trial.

Evelyn’s attorney argued that the nursery incident showed family conflict, not incapacity fraud. He described Maya as exhausted, emotional, and dependent on medication.

Dr. Morris explained that the medication caused many of the symptoms.

The baby-monitor company authenticated the recording.

The security logs confirmed the door had been locked from outside.

The forged signature was traced to a digital stamp stored on Evelyn’s office computer.

Maya testified briefly.

She did not claim perfect health.

“I was tired. I was frightened. I cried. None of those facts gave another person the right to take my child, my vote, or my medical decisions.”

The judge dismissed the petition and issued protective orders.

Maya retained full parental and financial capacity.

Caleb’s parental role remained intact under a temporary family-safety plan requested by Maya.

He accepted the oversight.
